1.1 AAA Black is a business name of Evie Digital Pty Ltd (ABN 74 610 455 340) (“AAA Black”, “we”). We arrange chauffeured transport in the Northern Rivers, Gold Coast and Brisbane regions of Australia, booked through aaablack.com.au, by Web, SMS or WhatsApp to our booking number, or to email. Evie Digital Pty Ltd is an authorised booking service provider under the Point to Point Transport (Taxis and Hire Vehicles) Act 2016 (NSW), authorisation BSP-466370.
1.2 These terms apply to every booking. By confirming a booking you accept them. If you book for other people, you confirm you are authorised to accept these terms on their behalf and will make sure they follow them.
1.3 Rides are provided in one of three ways: by AAA Black in a vehicle it owns; by a partner operator we work with, using their vehicle and chauffeur; or by an independent chauffeur partner using their own vehicle. In every case AAA Black takes the booking, is your point of contact and handles payment; clause 9 explains who is responsible for what.
1.4 Whoever provides the ride, every chauffeur is onboarded and verified by AAA Black before their first job. We check and hold a record of their driver licence, the driver authority required for booked hire-car work in the state they operate in, their insurance, and the age, registration and condition of the vehicle, and we track the expiry of each. Chauffeurs accept our operational standards as a condition of taking work from us. We do not send you a chauffeur we have not vetted.
1.5 We do not guarantee a particular vehicle, chauffeur or operator. What we guarantee is the class of vehicle you booked — currently a Mercedes-Benz S-Class or equivalent — and the standard of service in these terms. The individual car, its operator and the chauffeur may differ from the one first allocated and may change at any time before pickup, including where a chauffeur becomes unavailable. If we cannot provide the class of vehicle you booked, we will tell you before the trip and you may accept the alternative or cancel for a full refund.
2.1 A booking request is not a confirmed booking. We confirm a booking when we have allocated a chauffeur and sent you a payment request; the booking is complete when payment is received. Until then we may decline a request, for example if no chauffeur is available.
2.2 You must give accurate details: pickup and drop-off addresses, date and time, flight number if any, number of passengers, luggage, and any child seats needed. We rely on these to allocate a suitable vehicle. If the details on the day differ (more passengers, more or larger luggage, a child without a booked seat) the chauffeur may be unable to carry you, and clause 5 applies.
2.3 Prices shown for airport transfers, point-to-point and hourly bookings within our standard pricing area are fixed at the time of booking. Bookings outside that area, or with a pickup before 4.00am or after 10.00pm, are priced individually and confirmed to you before you commit. You are never charged until you pay the link we send.
2.4 Prices include GST, tolls on the direct route, and standard waiting time (clause 4). A terminal meet-and-greet at an airport is an extra $25 if selected. Pickups between 4.00am and 5.59am or 8.00pm and 10.00pm carry a 10% after-hours surcharge, shown before you confirm.
3.1 Payment is by card through a secure Stripe link sent to you once your chauffeur is confirmed. Your booking is not guaranteed until payment is received. If payment is not received within 24 hours of the request, or before the pickup time if sooner, we may release the chauffeur and cancel the booking.
3.2 Account customers approved by us may instead pay by invoice on the terms of their account.
3.3 We do not store your card details; Stripe does, under its own terms.
4.1 Airport arrivals. Your pickup time is your flight’s scheduled landing time. Your chauffeur tracks the flight in real time, adjusts to delays at no charge, and waits for you to clear the terminal. If you selected a terminal meet, your chauffeur waits in the arrivals hall with a name board; otherwise they will contact you to meet at the pickup zone.
4.2 All other pickups. Your chauffeur will be waiting at the booked time. If you are running late, a quick message to the booking number lets us plan around it.
4.3 If we cannot find you. If you have not appeared and we cannot reach you within a reasonable time after the pickup (or after landing), the chauffeur may leave and the booking is treated as a no-show. We may keep some or all of the fare in that case, reflecting the chauffeur’s lost work; we consider the circumstances and will tell you.
4.4 Hourly bookings run from the booked pickup time for the booked hours. Additional time, if the chauffeur is able to continue, is charged at the hourly rate.
5.1 The number of passengers and amount of luggage must not exceed what was booked or what the vehicle can safely carry. Our vehicle seats up to four passengers and carries two standard check-in cases and one carry-on or similar. Larger groups and loads can be arranged separately on request; please contact us before booking.
5.2 Children under seven must travel in an approved child restraint as required by law. We do not supply child restraints in our standard vehicle. A vehicle with an approved restraint can be arranged on request; please contact us before booking. If a child cannot legally be carried, the chauffeur will not be able to take the ride.
5.3 The chauffeur may refuse to carry passengers or luggage where it would be unsafe or unlawful, and may refuse or end a ride if a passenger is abusive, intoxicated to the point of risk, or damages the vehicle. In those cases the fare is not refunded.
5.4 We do not carry pets. Assistance animals are always carried, as the law requires. We may allocate a different vehicle for that trip at no additional cost to you, and we ask that you tell us before booking so it can be arranged.
6.1 No smoking or vaping in any vehicle. Food and drink only with the chauffeur’s agreement. Seatbelts must be worn.
6.2 We ask you to treat the vehicle as you would your own. If a vehicle is damaged or needs specialist cleaning because of a passenger’s actions, we may ask you to cover the reasonable cost.
7.1 Changing a booking. Contact us on the booking number. We will accommodate changes where a chauffeur is available; a change of time, date or route may change the price. A change that the chauffeur cannot accept is treated as a cancellation and rebooking.
7.2 Cancelling. Cancel up to 24 hours before your pickup for a full refund. Inside 24 hours your chauffeur has held the time for you, so the booking may be charged some or all of the fare — if something has gone wrong, tell us and we will do what we can. We tell you the refund amount when we confirm the cancellation. Refunds go to the original payment method and usually show within 3–7 business days.
7.3 Return and multi-vehicle bookings may be changed or cancelled per trip or per vehicle; the rest of the booking is unaffected.
7.4 If we cancel. If we cannot provide a chauffeur (vehicle breakdown, illness, no available replacement) we will tell you as early as we can and refund you in full. Where we can, we will offer an alternative first.
7.5 Nothing in this clause limits your rights under the Australian Consumer Law.
We will help you recover items left in a vehicle, but neither we nor the chauffeur is responsible for items left behind. Return of items is at your cost.
9.1 Our services come with guarantees under the Australian Consumer Law that cannot be excluded, including that services will be provided with due care and skill. Nothing in these terms excludes, restricts or modifies those guarantees.
9.2 Where a ride is provided by an independent chauffeur partner, the chauffeur is responsible for the driving and for the vehicle, and holds the licences and insurance the law requires. AAA Black is responsible for arranging the ride, for the booking and payment process, and for its own conduct. Where AAA Black provides the vehicle, AAA Black is responsible for the ride.
9.3 To the extent the law allows, neither AAA Black nor a chauffeur is liable for delay or failure caused by things outside their reasonable control (traffic, weather, road closures, flight changes, accidents involving others), for indirect or consequential loss, or for a missed flight or connection where you booked a pickup time that did not allow reasonable travel time. Our liability for anything that cannot be excluded is limited, where the law permits, to supplying the service again or paying the cost of having it supplied again.
9.4 Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
We collect and use your details as described in our Privacy Policy. By booking you agree that we may contact you about your booking by SMS, WhatsApp, email or phone, and that your name and phone number will be given to your chauffeur for the purpose of the ride.
11.1 These terms are governed by the law of New South Wales, Australia. Disputes are subject to the courts of New South Wales, without limiting your right to bring a claim under consumer law where you live.
11.2 We may update these terms; the version in force when you book applies to that booking.
